As per section 27-126 of the NYC Building Code, a work permit is required for the following: the cutting away of any wall, floor, or roof construction, or any portion thereof; or the removal, cutting, or modification of any beams or structural supports; or the removal, change, or closing of any required means of egress; or the rearrangement or relocation of any parts of the building affecting loading or exit requirements, or light, heat, ventilation, or elevator requirements; additions to, alterations of, or rearrangement, relocation or removal of any standpipe or sprinkler piping, water distribution piping, house sewer, private sewer, or drainage system, including leaders, or any soil, waste or vent pipe, or any gas distribution system, or any other work affecting health or the fire or structural safety of the building.

Construction activities are limited to Monday through Friday from 7:00 AM to 6:00 PM. An after hour or weekend variance can be requested from the Department of Buildings when special concerns must be considered. All variances are reviewed on a case by case basis.

A Department of Buildings construction permit is usually for construction activities performed within the property line. Department of Buildings construction permits can also cover construction activities such as an awning and a marquee installation. The Department of Transportation issues permits for all other permits affecting sidewalks and streets.

The Department of Buildings does not review electrical drawings. However, prior to starting work, a licensed electrical contractor must submit an application for a Certificate of Electrical inspection with the Bureau of Electrical Control.

A place of Assembly is one where 75 or more members of the public gather indoors or 200 people or more gather outdoors for religious, recreational, educational, social or political purposes or to consume food or drink. An example of a Place of Assembly is a restaurant or conference room with more than 75 seats.
